TIME LIMITS
All Australian states and territories require claims for compensation to be made within specified time periods. These periods vary depending on both which State the accident was in and the type of claim.
In most States, the time limitation period for commencing court proceedings in motor vehicle, medical negligence and public liability compensation claims is three years. In most motor vehicle compensation cases formal notice of the claim must be given to the relevant insurer within six months of the date of the accident.
While these time limits can be extended in certain circumstances, it is critical that compensation claims be commenced as soon as possible.
